Terms of Service

• “Service” means the AssessThis AI platform, website and all related features that enable users to generate risk assessments and COSHH assessments.
• “User”, “you” means any individual or organisation that accesses or uses the Service.
• “Content” means any information, documents, text, images or files created, uploaded or generated through the Service.

You must be at least 18 years old and capable of forming a legally binding contract to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must provide accurate and complete information when registering and keep it up to date. Please notify us immediately of any unauthorised use of your account.

The Service uses artificial intelligence to help you generate risk assessments, COSHH assessments and related health and safety documentation based on the information you provide. The Service is intended as a professional drafting and productivity tool to assist competent persons in preparing such documentation.

Important: The documents produced by the Service are generated with the assistance of artificial intelligence and are provided as drafts to support your own professional judgement. They are not a substitute for competent, qualified health and safety advice.

• You are solely responsible for reviewing, verifying, editing and approving all generated content before use or reliance;
• You must ensure that any assessment is suitable and sufficient for your specific circumstances and complies with all applicable laws, regulations and approved codes of practice;
• AI-generated content may contain errors, omissions or inaccuracies, and we do not warrant that it is complete, accurate or fit for any particular purpose; and
• You should always consult the relevant safety data sheets, manufacturer guidance and, where appropriate, a qualified health and safety professional.

You agree that you will:

• Use the Service only for lawful purposes and in accordance with these Terms;
• Provide accurate and complete information when generating assessments;
• Not use the Service in any way that infringes the rights of others or breaches any applicable law;
• Not attempt to gain unauthorised access to, interfere with or disrupt the Service or its infrastructure; and
• Not upload any content that is unlawful, harmful, or that you do not have the right to upload.

The Service operates on a pay-as-you-go basis. A charge of £3 (GBP) applies per assessment in order to download and share the completed document. There is no subscription and you pay only when you choose to download an assessment. All prices are stated in pounds sterling and are inclusive of any applicable taxes unless otherwise stated.

Payments are processed securely by our third-party payment provider, Stripe. By making a payment, you agree to Stripe’s terms and authorise the charge to your chosen payment method.

Because each assessment is a digital product generated and made available to you immediately upon payment, payments are generally non-refundable. However, we will provide a refund in the following circumstances:

• Documentation rejected by a third party. Where a document you have paid for is subsequently rejected by a third party (such as a principal contractor, client, or other reviewing body), you may be entitled to a refund.
• Documentation that has not fully generated. Where a document fails to generate completely or is otherwise incomplete due to a technical fault on our part, you may be entitled to a refund.

In both cases, we reserve the right to first investigate and rectify the issue — for example, by regenerating, correcting, or amending the affected document — prior to any refund being issued. Where we are able to resolve the matter to a satisfactory standard, a refund may not be provided. To raise a request, please contact us via our Contact Support page with details of the affected document and the reason for the request, and we will respond promptly.

The Service, including its software, design, branding and underlying technology, is owned by AssessThis AI and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable licence to use the Service in accordance with these Terms.

You retain ownership of the information you input and the completed assessment documents you generate and pay for. You may use those documents freely for your own business purposes.

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties or representations, whether express or implied, regarding the Service or the content it generates, including any implied warranties of merchantability, fitness for a particular purpose, accuracy or non-infringement. We do not warrant that the Service will be uninterrupted, error-free or secure.

To the fullest extent permitted by law, AssessThis AI shall not be liable for any indirect, incidental, special, consequential or punitive damages, or any loss of profits, revenue, data or goodwill, arising out of or in connection with your use of, or inability to use, the Service.

Our total aggregate liability arising out of or in connection with the Service shall not exceed the greater of (a) the total amount you paid to us in the twelve months preceding the event giving rise to the claim, or (b) £100. Nothing in these Terms excludes or limits our liability for death or personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law.

You agree to indemnify and hold harmless AssessThis AI and its officers, employees and agents from and against any claims, liabilities, damages, losses and expenses arising out of your use of the Service, your Content, or your breach of these Terms or of any applicable law.

We may suspend or terminate your access to the Service at any time if you breach these Terms or if we reasonably believe your use of the Service poses a risk to us or other users. You may stop using the Service and close your account at any time. Provisions that by their nature should survive termination will continue to apply.

We may modify or discontinue the Service, or update these Terms, from time to time. Where we make material changes to these Terms, we will update the “Last updated” date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the revised Terms.

These Terms and any dispute or claim arising out of or in connection with them are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction to settle any such dispute or claim.
